MBE Overview
The MBE is a 200-question multiple choice exam testing seven subjects: Civil Procedure, Constitutional Law, Contracts, Criminal Law & Procedure, Evidence, Real Property, and Torts.
You'll have 3 hours for each 100-question session. That's 1.8 minutes per question on average. The MBE accounts for 50% of your UBE score.
Question Approach
Read the Call First
Start with the question stem. Knowing what you're looking for helps you read the fact pattern more efficiently.
Identify the Subject
Determine which of the seven subjects is being tested. This activates the right mental framework for analysis.
Spot the Issue
What legal issue does the question present? The answer choices often help clarify this.
Eliminate Wrong Answers
Often 2-3 answers are clearly wrong. Narrow down to maximize your chances.
Trust Your Preparation
Your first instinct is usually correct. Don't second-guess unless you have a clear reason.
Time Management
- Don't linger - If stuck, make your best choice and move on
- Track your pace - You should complete about 33 questions per hour
- Flag and return - Mark difficult questions to revisit if time permits
- Save time for review - Aim to finish with 10-15 minutes to spare

Contracts
Always determine if the UCC or common law applies. Check for merchants. Look for consideration issues.
Torts
Identify the standard of care. For negligence, systematically work through duty, breach, causation, and damages.
Evidence
Focus on hearsay and its exceptions. Know the difference between relevance and admissibility.
Constitutional Law
Identify the correct level of scrutiny. State action is often key.
Criminal Law
Distinguish between specific and general intent crimes. Know the elements cold.
Civil Procedure
Personal jurisdiction and subject matter jurisdiction are heavily tested. Know your Erie doctrine.
Real Property
Future interests and RAP can be tricky. Draw timelines for complex conveyancing problems.
