Types of Law School Exams
Most law school courses use one of these exam formats:
Issue-Spotting Essays
The most common format. You're given a fact pattern and must identify legal issues, state rules, apply them to the facts, and reach conclusions.
Policy Essays
Ask you to analyze or argue about legal policy, often drawing on course themes and scholarly debates.
Multiple Choice
Test rule knowledge and issue recognition. Common in courses like Evidence and Civil Procedure.
Take-Home Exams
Longer time limits (8-24 hours) but higher expectations for depth and polish.
Preparation Strategy
Throughout the Semester
- Attend class and take good notes
- Brief cases (or use pre-written briefs efficiently)
- Start outlining early - don't wait until reading period
- Form study groups for discussion and review
Two Weeks Before
- Finalize your outline
- Create a one-page attack outline for each subject
- Start doing practice exams
One Week Before
- Do at least 2-3 full practice exams under timed conditions
- Review your answers against model answers
- Identify weak areas and review those rules
Exam Day
- Read the call of the question first - Know what you're being asked before reading the facts
- Allocate time by points - If a question is worth 50% of the grade, spend 50% of your time on it
- Outline before writing - A 5-minute outline saves time and improves organization
- Don't skip issues - Professors give points for spotting issues, even if your analysis is brief
- Leave time to review - Catch typos and add missed points
Writing Exam Answers
Use IRAC
Issue, Rule, Application, Conclusion. This structure ensures you hit all the points.
State Rules Completely
Include all elements, not just the ones at issue. Show the professor you know the full rule.
Apply Facts Specifically
Don't just restate facts. Explain how they satisfy (or don't satisfy) each element.
Address Both Sides
Strong answers consider counterarguments. "Plaintiff will argue X, but defendant will counter that Y."
Reach a Conclusion
Professors want to see your judgment. Make a call, even if it's close.
